1 Terms and Conditions, General Terms and Applicability

1.1 All deliveries and services provided by FRAAS USA are carried out exclusively on the basis of the following Terms and Conditions in the version which is currently valid at the time the order is placed.

1.2 Consumers referred to in the Terms and Conditions are natural persons who make a contractual agreement with FRAAS USA for purposes which cannot be considered a part of either their professional or commercial activities.

1.3 Customers referred to in the Terms and Conditions may be either consumers or business customers.

1.4 Informal agreements are non-existent.

2 Privacy Policies

FRAAS USA is commited to protecting your privacy as we recognize that your personal information must be used responsibly and handled with care.  Please refer to our Privacy Policy by clicking on this link or by accessing the website directly.

3 Recording the Text of the Purchase Contract

3.1 Your order and the ordering data entered will be recorded by FRAAS USA. We will send you an order confirmation with all entered data to the e-mail you indicated when you placed your order. In the course of making the order, you will have the opportunity to print out your order as well as the Terms and Conditions.

3.2 Further, you may establish a customer account when placing your initial order to the FRAAS USA online shop: Your order and the order information you enter will be recorded in your personal customer account. Using the log-in data which you determine when you first register will always have access to your customer account and have the opportunity to print out your order with all pertinent data.

4 Confirmation of the Purchase Contract, Ordering Process

4.1 The contract is valid only upon transmission of an order confirmation seen after an order is placed or, sent by e-mail.

4.2 Orders make a binding contract with FRAAS USA. When product selection has been made, you may place your selection (without sustaining any obligation) into the shopping cart by clicking on the button, "add to cart". You may view the contents of the shopping cart at any time without sustaining any obligation by clicking on the button "X articles in cart". The products may be removed from the shopping basket at any time by clicking on the button "delete". When ready to purchase the articles in the shopping basket click on the button, "go to check out."

4.2.1 The ordering process comprises of four steps. In the first step, "login" if you have established a customer account and enter your customer data, or you may continue the purchase process without establishing a customer account. In the second step enter your address in the area designated. Should the billing and delivery addresses differ, you may adjust this here. In the third step indicate your method of payment. In the last step "check & order" you will have the opportunity to check your ordering information for accuracy. At this time you may correct any data entry errors by changing the billing address, delivery address, the method of payment and either deleting or editing the quantity of articles. You will have completed the order when you activate the button on the order form "Place Order" which will send the order to us. Then you will next receive a confirmation that we have received your order. Upon receipt of a subsequent order confirmation which you should receive within 48 hours of the time you have sent your order FRAAS USA will be able to accept your offer (order) as a binding contract.

4.2.2 The final steps to the order process will include taxation of the goods. Orders shipping to New York State will be taxed appropriately according to the location's tax rate. Shipping will be taxed as it is taxable in New York State.

5 Right of Cancellation of Order and Return Policy

5.1 Right to cancel

You have the right to cancel this contract within 14 days without giving any reason.

The cancellation period will expire after 14 days from the day on which you acquire, or another party (indicated by you acquires, i.e. gifts), physical possession of the last good.

It is imperative for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

5.2 Effects of cancellation (returns) 

If you cancel this contract, we will reimburse you all payments received, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the standard delivery offered by us). We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling. We will make the reimbursement without undue delay, and not later than – (a) Within 14 days after we receive the goods returned, or (b) (if earlier) 14 days after the day you provide evidence that you have returned the goods. We will reimburse payment using the same means of payment used in the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received goods to be returned or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the items purchased and wished to be returned without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract with FRAAS. The deadline is met if you return the goods before the period of 14 days has expired.

Unfortunately at this time, we provide free returns for EU customers only. U.S. customers have to pay return costs at their own expense with the parcel service of their choice.

6 Proprietary Rights

Until completely paid for, the items remain the property of FRAAS. Before the property rights have been transferred it is not allowed to use the goods as collateral, to put them up for pawn, to alter or further process in any way without our expressed permission.

7 Shipping and Handling

7.1 All prices include the value plus tax required by law, this includes shipping costs as per the tax laws of New York State. Taxes differ by county.

7.2 Shipping costs are calculated on a flat-rate basis and differ by shipping location.

7.3 FRAAS USA ships within the United States only. If you are currently residing in another country, please visit the appropriate website to make your purchase:

7.3.1 Please note purchases made by special request to countries outside the EU, customs fees may apply which will be collected from you directly by the respective customs authorities. All applicable customs fees and import duties are the responsibility of the receiver. The customer is to observe his national import regulations for all products. We assume no responsibility for the conformity of our products with national rules and regulations outside the EU.

7.4 All goods will be shipped by United Parcel Service (UPS).

7.5 UPS has six (6) day transit times for parts of Oregon, parts of Idaho, Puerto Rico, and Hawaii. If you live within these regions of the United States please factor additional delivery time.

7.6 Orders places Monday through Thursday will be shipped within 48 hours. If an order is placed after 1:30 PM EST Monday through Thursday, it will be processed on the next business day. Orders placed on Friday after 12:00 PM EST will ship within the next two (2) business days.

7.7 Should items ordered not be in stock, we reserve the right to make partial or delayed shipments at our expense if it is acceptable and convenient to you, the customer. FRAAS USA will notify the customer of this situation.

7.8 Should the receiving of a delivery of the goods fail after three attempts, we may withdraw from the contract. We will return to you without delay all applicable payments that have already been made.

8 Terms of Payment

8.1 FRAAS USA reserves the right to exclude particular payment methods.

8.2 FRAAS USA accepts all major credit and debit cards: Visa, MasterCard and American Express. Your card will be charged only upon placement of order. Prices displayed on FRAAS online shop are open to questions or comments about these Terms. You can reach our customer service representative at cs.usa@fraas.com or at 1-844-786-3477, Monday to Thursday from 8 AM to 4:30 PM and Friday from 7:30 AM to 1:30 PM EST.

8.4 In the event that FRAAS USA cannot ship the ordered goods due to the failure of a FRAAS USA supplier to fulfil its contractual obligations, then FRAAS USA has the right to rescind the contract with the customer. In this case, the customer will be informed without delay that the goods desired are not available. The legal rights of the customer remain valid. Any applicable payments will be returned to the customer without delay.

8.5 If payment is not valid, your order will be not be received and therefore not completed. If you’re having trouble with payment and have valid funds, please contact our customer service representative at 1-844-786-3477 or cs.usa@fraas.com.

8.6 Adjustments to payment may be made only if your claim has been ruled legally valid by our customer service or in a rare case, the court system, are not contested or have been acknowledged by us in writing.

8.7 The right of retention is applicable only if the claim results from the same contractual instance.

8.8 Concerning price adjustments, if an item is on sale after a purchase, FRAAS USA can apply a price adjustment if you, the customer contacts our customer service team within 14 days from the order date. FRAAS USA cannot apply a price adjustment if an item is out of stock.

9 Product Guarantee

If you, the customer are unhappy about any goods or services received, please contact our customer service representative at 1-844-786-3477 or cs.usa@fraas.com and FRAAS USA will resolve any issues to the best of our ability.

11 Terms of Use

11.1 FRAAS USA and V. FRAAS USA, INC. grant you access to its website and online shop with the condition you, the customer accepts the Terms and Conditions and Terms of Use contained herein.

11.2 FRAAS USA commits to provide the most current and accurate information on our website and online shop. However, the information on the website and online shop may contain typographical errors or inaccuracies that may not be complete or current. Therefore, FRAAS reserves the right to correct any errors, inaccuracies or omissions. This includes after an order is submitted, and FRAAS can change or update information at any time without prior notice.

11.3 Use and restrictions

FRAAS USA website and online shop should only be used in accordance with all applicable laws and with these Terms. You acknowledge and agree that FRAAS USA, without notice or obligation to you, the customer, may suspend or cease your access to our website and online shop if we found you breached our Terms.

11.4 Copyright and trademark

In regards to the FRAAS and V. FRAAS copyright and trademarks, all materials published on our website, including by not limited to, product descriptions, logos, photographs, images illustrations, Cashmink®, and pricing information are the property of FRAAS and V. FRAAS and are protected by copyright and intellectual property laws. You shall not use any Content without the consent of FRAAS and V.FRAAS that falls outside the Terms of Use.

12 Miscellaneous

Should one or more of the provisions set forth in these Terms and Conditions prove invalid, then the contract remains valid in all other points. In as much as the provisions are invalid, the content of the contract will be regulated according to the requirements of law.

Please note FRAAS USA is closed beginning December 23 and will reopen for business on January 2.
